La science du droit dans la globalisation

It is now customary to evoke the « globalization » or « globalization » of the law. The purpose of the book is neither the description of this phenomenon nor even the verification of its empirical relevance. The starting point remains the theory of law in a context of globalization of norms and new dimensions of conflicts between norms and regulation.

The book pursues the deepening of the theory of law in its confrontation with the stakes of the meaning of law in the context of a more global and internationalized society. It examines from an analytical point of view the concept of legal pluralism starting from the distinction of the different uses of this concept in the theory and analysis of the law. It confronts the perspectives of analytical theory and pragmatic approaches.

It illustrates some of the contributions of theoretical and critical reflections on « global law » to a better understanding and conceptualization of law in the fields of international law, human rights, European law and constitutional law.

In doing so, it underlines the need, in the age of globalization, for the development of the training of jurists in the fields of theory and the philosophy of law.
