Alberto Lucarelli tackles a crucial issue: the transition from a top-down, organicistic public law based on representation to a public right that is articulated in the community and that seeks its deepest reason precisely in social dynamics, in general aims, in those common goods which are the permanent elements of public policies. With a further objective: to outline what the legal instruments and categories may be to get out of the crisis of the social dimension of law, and its impotence, to achieve a substantial democracy.
